Learning Spot t/a The Builders Academy supplies specific courses to independent third-party companies who resell access to their own learners. These resellers operate entirely under their own brand names and are not agents, employees, or representatives of Learning Spot t/a The Builders Academy.

Learners enrolled through such resellers remain registered students within our learning system, and our responsibility is limited to providing access to the purchased course content and certification in accordance with our Terms and Conditions.

As part of the enrolment process, learner details are provided to Learning Spot t/a The Builders Academy by the reseller. It is the sole responsibility of the reseller to obtain the learner’s explicit consent to share their personal information for this purpose. Learning Spot t/a The Builders Academy assumes that such consent has been lawfully obtained before enrolment.

Once learner data is received, Learning Spot t/a The Builders Academy acts as the Data Controller only for the duration of the learner’s participation in the course. We process all learner data strictly in line with our Privacy Policy and in full compliance with UK data protection legislation.

•    your work, progress, or assessment data will not be lost due to system failure, connectivity issues, or user error.

10A.3 Learning Spot t/a The Builders Academy shall not be liable for any direct, indirect, or consequential losses, including but not limited to data loss, interruption of study, lost earnings, or any other damages arising from the use or inability to use our website, LMS, or related systems.

10A.4 In cases where a technical issue prevents completion of an assessment, we may, at our sole discretion, offer a free or discounted retake. This is provided purely as a goodwill gesture and does not constitute an admission of fault or liability.

10A.5 Users are responsible for ensuring they have a reliable internet connection, a compatible device, and a stable power source during online assessments. We recommend saving progress frequently and completing courses using a desktop or laptop device rather than mobile equipment, where possible.

10A.6 By using our website or LMS, you acknowledge and agree that you do so at your own risk and accept full responsibility for maintaining suitable hardware, software, and connectivity to access our services.

11. Termination

11.1 We reserve the right to terminate or suspend your access to our services at any time, without notice, for conduct that we believe violates these terms and conditions or is harmful to other users of the services, us, or third parties, or for any other reason in our sole discretion.
